Website, Donations and Queensland Raffle / Art Union Entry Terms
GiveBack Gold Limited (ACN 696 870 201)
Last updated: 6 October 2026
Important: These terms are designed for GiveBack Gold’s Queensland operations and online service. Each raffle must also have draw-specific information published at the point of sale. GiveBack Gold must confirm before each draw that the conducting entity is legally entitled to conduct that category of game. These terms do not replace a Queensland gaming licence where one is required.
These Terms govern access to GiveBack Gold’s website and online services, donations, accounts, and entry into raffles or art unions conducted by GiveBack Gold where permitted by law. By using the website, making a payment, or purchasing an eligible raffle entry, you agree to these Terms and the draw-specific conditions displayed for that draw.
Queensland charitable raffles and art unions are regulated principally under the Charitable and Non-Profit Gaming Act 1999 (Qld), the Charitable and Non-Profit Gaming Regulation 1999 (Qld) and applicable gaming rules. GiveBack Gold will conduct a raffle only where the conducting entity is authorised to do so and will comply with any licence, approval or statutory condition applying to that draw.
Category 2: For an eligible association, a raffle/art union with gross proceeds above $2,000 and not more than $50,000 may generally be conducted without a Category 3 gaming licence. Total retail prize value must be at least 20% of estimated gross proceeds.
Category 3: If estimated gross proceeds exceed $50,000, the game generally requires a Category 3 gaming licence and the applicable licence number must be used where required.
Entity eligibility: Incorporation or company registration by itself does not automatically establish eligibility to conduct a Category 2 game. GiveBack Gold must satisfy the statutory requirements for an ‘eligible association’ or otherwise hold the authority required for the relevant game.
Before tickets are sold, GiveBack Gold will publish the material conditions for the draw. For a Category 2 or 3 art union, ticket and advertising information will include, as applicable:
• the name of the person or entity conducting the draw;
• ticket price and a unique ticket number or other compliant identifier;
• closing date and drawing date;
• how winners will be notified and how results will be published;
• the description and retail value of each prize;
• the order in which prizes will be drawn where it differs from the statutory/default order; and
• any gaming licence number required for a licensed Category 3 or special Category 3 game.
Unless a draw states a stricter rule, entrants must provide accurate contact details and be legally capable of entering. GiveBack Gold may impose an 18+ entry condition as a business safeguard and may request reasonable proof of identity, age or eligibility before releasing a prize.
For Category 2 or 3 art unions, persons who are legally ineligible will not be permitted to enter. This includes relevant management committee members, persons directly engaged in conducting the draw, the eligible association itself, and immediate family members of specified persons where the gaming rules prohibit their entry.
A ticket is valid only when the correct ticket price has been paid and the entry has been successfully issued and recorded. A payment receipt alone does not create a winning entitlement if no valid ticket was issued.
If a person pays an entry fee but is not issued a ticket, or their ticket is not included in the draw, GiveBack Gold will provide the refund required by Queensland gaming law as soon as practicable.
Tickets are not transferable where a draw is expressly stated to be non-transferable. GiveBack Gold may cancel duplicate, fraudulent, chargeback-related or unlawfully obtained entries, subject to applicable law.
Where GiveBack Gold is legally entitled to conduct the relevant charitable or non-profit game online, entries may be purchased through the website or an approved service provider. Entrants are responsible for ensuring their internet connection, payment details and contact details are correct. GiveBack Gold will use reasonable safeguards to maintain accurate electronic entry records.
Each valid ticket must have a fair and equal chance of winning the major prize, subject to any lawful exception. Winners will be selected by the draw method disclosed for the particular raffle.
If an electronic random number generator or electronic draw system is used, GiveBack Gold will use a system and process appropriate to the category of game and applicable Queensland requirements.
If more than one prize is offered, prizes will be drawn in the legally required order unless a different lawful order was disclosed when tickets were issued.
If an unsold ticket is drawn in circumstances where unsold tickets are included, another ticket will be drawn until a valid winner is determined.
Prize descriptions and retail values will be published before entry. GiveBack Gold will not offer a prize prohibited by Queensland law.
For a Category 2 raffle/art union, the total retail value of prizes will be at least 20% of estimated gross proceeds.
For games other than lucky envelopes, Category 3 games or promotional games, Queensland regulations restrict a cash prize to no more than $25,000.
Other statutory prize restrictions also apply, including restrictions concerning tobacco, weapons, ammunition, certain regulated items and alcohol.
Where an existing prize valued above the statutory threshold must be insured, GiveBack Gold will arrange the required cover.
A prize is not exchangeable for cash unless the published draw terms expressly allow it and doing so is lawful.
Any taxes, registration, transfer, travel, insurance or incidental costs not expressly included in the prize description are the winner’s responsibility.
GiveBack Gold may verify a winner’s identity, eligibility and ticket details before awarding a prize. Results will be published or made available in the manner disclosed when tickets are sold.
Winners will be notified using the contact details held for the entry and within any period required by law.
GiveBack Gold may publish a winner’s name, suburb/locality, winning ticket number and prize where disclosed in the draw conditions and permitted by privacy law.
Any promotional photograph, interview or story beyond what is reasonably required to administer and publicise the draw will be handled in accordance with the Privacy Policy and any consent obtained.
GiveBack Gold will hold and account for unclaimed prizes for the period required by Queensland law and will make reasonable efforts to locate the winner.
If a prize cannot be given to the winner, GiveBack Gold will follow the applicable statutory process, including any required notice to the regulator and lawful treatment of the unclaimed prize.
GiveBack Gold will not change a closing date, draw date, prize or material condition except where permitted by law.
Any lawful extension or material change will be communicated in the manner required for that category of game.
If a draw cannot lawfully proceed, GiveBack Gold may cancel it and will deal with ticket payments as required by law.
A donation is separate from a raffle ticket unless the transaction clearly states otherwise.
GiveBack Gold will apply fundraising and gaming proceeds consistently with its legal obligations, charitable/non-profit purposes and any representations made for the relevant campaign.
No director, officer, contractor or other individual may derive an unlawful personal gain from the conduct of a charitable game.
Raffle entries are generally final once a valid ticket has been issued, except where a refund is required by law, the draw is cancelled, a ticket is not issued or included as required, or GiveBack Gold decides that a refund is appropriate and lawful.
Donations are generally non-refundable except for processing error, unauthorised transaction, legal entitlement or another circumstance accepted by GiveBack Gold.
If accounts are offered, you must provide accurate, current information and keep login credentials secure.
You must promptly notify GiveBack Gold of suspected unauthorised access.
GiveBack Gold may suspend an account to investigate fraud, misuse, chargebacks, unlawful activity or a breach of these Terms.
You must not misuse the website, interfere with its security or operation, impersonate another person, submit unlawful or infringing content, scrape or harvest personal data, introduce malicious code, attempt unauthorised access, or use the service in a way that breaches applicable law.
Transactional messages relating to entries, payments, security, draw administration and prizes may be sent as necessary.
Marketing communications will be sent only where permitted, and recipients can use the unsubscribe facility or contact GiveBack Gold to opt out of marketing.
Unless otherwise stated, the GiveBack Gold name, branding, website content, graphics and original materials are owned by or licensed to GiveBack Gold.
They may not be reproduced or commercially used without permission, except as allowed by law.
The website may use third-party payment processors, hosting providers, analytics services and other suppliers. Their services may also be subject to their own terms and privacy policies.
GiveBack Gold is not responsible for independent third-party services to the extent permitted by law.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
To the maximum extent permitted by law, GiveBack Gold is not liable for indirect or consequential loss arising from use of the website, interruptions, third-party systems or events outside its reasonable control.
This clause does not limit liability that cannot lawfully be excluded.
Personal information is handled under GiveBack Gold’s separate Privacy Policy. The Privacy Policy should be made available on the website independently from these Terms.
These Terms are governed by the laws of Queensland, Australia.
If a term conflicts with mandatory Queensland gaming law, the mandatory law prevails and the affected term is read down to the minimum extent necessary.
GiveBack Gold may update these Terms prospectively to reflect legal, regulatory or operational changes.
Questions, complaints, refund requests or raffle concerns should be submitted using the contact details published on the GiveBack Gold website.
Gaming complaints will be reviewed against the applicable draw terms and Queensland gaming requirements.
Before launch, GiveBack Gold should have the final structure reviewed against its actual constitution/company structure and fundraising status, because Category 2 availability depends on the conducting entity meeting Queensland’s ‘eligible association’ requirements.
